TERMS + CONDITIONS OF PURCHASE

All purchases made by any individual or entity (each, a “Buyer”) through this website (the “Website”) from Desert Sun Brand and Palota by Desert Sun (collectively, the “Seller”) are subject to the following Terms and Conditions:

1. Payment

Buyer agrees to pay the full purchase price for all goods at the time the order is placed, including any applicable sales tax, shipping, and handling fees. Orders will not be processed until payment has been received in full.

2. Ordering Process

To purchase one or more products on this Website, Buyer must follow the online ordering process, complete all required information fields, and confirm the purchase of the selected products in the shopping cart.

Once the order is confirmed, Buyer will receive a summary including all relevant order details, such as purchased items, pricing, shipping costs, delivery address, and applicable contractual information.

3. Final Sale Policy

All purchases are final. Orders are non-cancelable and non-refundable, except as expressly provided in Section 4 below.

4. Damaged, Defective, or Incorrect Items

Seller will only accept returns or claims for goods that are:

  • Damaged at the time of delivery

  • Defective upon arrival

  • Incorrect or incomplete due to Seller error

To be eligible, Buyer must:

  • Contact Seller within 36 hours of receiving the order

  • Provide clear photographic evidence of the issue

If Buyer does not notify Seller within this 36-hours, the goods will be deemed accepted and no claims will be honored.

5. Shipping and Delivery

5.1 Shipping Origin

All orders are shipped from Los Angeles, California, USA.

5.2 Delivery Address

Seller is not responsible for delivery errors resulting from incorrect, incomplete, or changed delivery information provided by the Buyer, including changes made after shipment.

5.3 Delivery Timeframes

Delivery times are estimates only and may vary due to logistics, carrier delays, or events beyond Seller’s control (including force majeure). Seller does not guarantee delivery dates.

5.4 Completion of Delivery

An order will be considered delivered when the shipping carrier confirms delivery according to its tracking system.

5.5 Condition Upon Delivery

Buyer is responsible for inspecting the package at the time of delivery. Any visible damage or irregularities should be noted with the delivery carrier upon receipt.

If the package shows signs of damage (including impacts, breakage, or tampering), Buyer must contact Seller via email within 36 hours of delivery to initiate a claim.

5.6 International Orders & Customs Fees

For international shipments, Buyer is solely responsible for any customs duties, import taxes, VAT, or additional fees imposed by the destination country.

Seller is not responsible for delays caused by customs or for unpaid duties. Failure to pay such fees may result in the package being returned or abandoned, and Seller is not responsible for refunds or reshipment in such cases.

6. Return Process

If a return is approved:

  • Seller will provide return instructions

  • Buyer must ship the item(s) back within 10 days of the original delivery date

  • Items must be returned in the condition received

Failure to follow return instructions may result in denial of the claim.

7. Resolution of Approved Claims

For approved claims, Seller reserves the right, at its sole discretion, to:

  • Replace the item at no additional cost

  • Issue store credit

  • Provide a refund for the product price and original shipping fees

8. Shipping Issues

Seller is not responsible for items lost or damaged in transit after shipment. Buyer must file any such claims directly with the shipping carrier.

9. Made-to-Order Items

Certain products are made specifically upon order (“Made-to-Order Items”), as indicated in the product listing.

These items require a processing time of approximately 5–10 business days prior to shipment.

By purchasing Made-to-Order Items, Buyer acknowledges and agrees to this production timeframe.

Made-to-Order Items are final sale and may not be canceled, returned, or refunded once production has begun, except in cases covered under Section 4.

10. Natural Materials & Product Variations

Some products are made using natural or vintage materials (including, but not limited to, coconut, stones, and other organic elements).

Due to the nature of these materials, each item may vary slightly in:

  • Size

  • Shape

  • Color

  • Texture

These variations are inherent and are not considered defects. By purchasing such items, Buyer acknowledges and accepts these natural differences. Additional details may be included in product listings.

11. Vintage Condition Disclaimer

Some items are vintage or pre-owned and may show signs of age, wear, or prior use.

This may include:

  • Minor scratches or patina

  • Fading or discoloration

  • General wear consistent with age

These characteristics are part of the item’s nature and are not considered defects. While Seller makes every effort to accurately describe and photograph items, minor imperfections may not always be visible.

All vintage items are sold as-is and are final sale.

12. Refused, Unclaimed, or Undeliverable Packages

If an order is refused, unclaimed, returned due to an incorrect or incomplete address, or returned due to unpaid customs duties:

  • Seller is not responsible for the loss of the package

  • Original shipping costs are non-refundable

If the package is successfully returned to Seller:

  • Buyer may request reshipment at their own expense

  • Seller reserves the right to deduct any return shipping or handling fees from any issued credit

Seller is not responsible for packages that are abandoned or not returned by the carrier.
